Victims' right to review

The Victims’ Right to Review only applies to decisions made on or after 1 April 2015 in cases where a suspect has been identified, formally interviewed under caution and either:

  • The police make a decision not to bring proceedings in cases where the police have authority to charge or
  • The police make a decision that the case does not meet the appropriate test for a referral to the Crown Prosecution Service (CPS) for a charging decision.

Who can request a review?

  • A direct victim of crime, where an allegation has been made to the police
  • A bereaved close relative of a victim of crime
  • The family spokesperson for families bereaved by crime
  • The family spokesperson for victims of crime who have a disability or for victims who have been so badly injured as a result of criminal conduct that they are unable to communicate
  • Parents or guardian of a victim who is under 18 years of age
  • All businesses that are victims of crime

How do I request a review?

There are a number of ways in which you can submit a request:

When you contact us please provide the following details:

  • Name of the person submitting the request
  • Address and contact details
  • Details of the victim
  • Address and contact details
  • Crime Report Reference number
  • Date and type of offence subject of police investigation
  • Brief outline of reasons supporting request for review

What will happen when you submit a request for review?

Your application will be assessed and a decision made.

If the decision is taken that your request does not fit the criteria, you will be informed in writing of the reasons for the decision. 

If your request is approved, you will be notified of this in writing and you will be contacted in due course by an Inspector who has been assigned responsibility for conducting an independent review of the evidence in the case.

Any case will be completed within 30 working days. At the conclusion of their investigation the Inspector will to notify you of the outcome of this review.
