Data Protection & Freedom of Information
In this section you will find details of your right to
access the information that we hold. This is broken down into two
sections, each covered by the Acts of Parliament detailed
below.
The Data Protection Act 1998 came into effect on 1st March 2000 and
provides individuals with a right of access to information that may
be held about themselves.
This is called subject access. It is a qualified right of access,
which does not extend to certain types of information including
information that might identify other individuals whose data is
held under a duty of confidence. For further details of how

Police Certificates
Individuals requiring Police Certificates for the purposes of
applications for emigration, visas, work permits or residency in
Australia, Canada, New Zealand and the United States of America
should download the application form for an ACPO Police Certificate
from the ACPO

the ACPO Criminal Records Office

The Freedom of Information Act (FOIA) came into force on the
1st January 2005 and it gives individuals the right of access to
all information held, subject to a range of
exemptions.
Information disclosed under FOI is released into
the public domain and not just to the applicant.

The force is obliged to publish certain classes of information that
have been agreed with the Information Commissioner and provide a
detailed guide as to how the published information may be
accessed.

Please note that where the Force receives a request for
information under FOI that relates specifically to the applicant,
i.e. personal data, a ‘Neither Confirm Nor Deny’ response will be
issued and the request will be passed to the section dealing with
Data Protection matters.
